User Agreement for the Bonk Live Video Social Platform

Welcome to Bonk. These Terms of Service ("Terms," "Agreement," or "ToS") constitute a legally binding contract between you ("User," "you," or "your") and Bonk and its affiliates, subsidiaries, and licensors (collectively, "Bonk," "we," "our," or "us") governing your access to and use of the Bonk mobile application, website, and all associated features, content, and services (collectively, the "Services").
By downloading, installing, registering for, or otherwise accessing the Services, you confirm that you: (a) have read and understood these Terms in their entirety; (b) are at least 18 years of age; (c) have the legal capacity to enter into a binding contract; and (d) agree to be bound by these Terms and all applicable policies incorporated herein by reference, including our Privacy Policy.
If you are accessing the Services on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization to these Terms. In that case, references to "you" shall include both you and that organization.
IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT DOWNLOAD, INSTALL, REGISTER FOR, OR USE THE SERVICES. YOUR CONTINUED USE OF THE SERVICES AFTER ANY MODIFICATION TO THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF SUCH CHANGES.
For the purposes of these Terms, the following definitions apply:
• "Account": The registered profile created by a User to access and use the Services.
• "Bonk Coins": The virtual in-app currency issued by ${APP_NAME} that can be used to purchase virtual gifts, premium features, and other in-app items.
• "Community Guidelines": The behavioral and content standards published by ${APP_NAME} that govern acceptable use of the platform, as updated from time to time.
• "Content": Any text, images, video, audio, messages, virtual gifts, profile data, or other material submitted, posted, broadcast, or transmitted by a User through the Services.
• "Intellectual Property Rights": All patents, copyrights, trademarks, trade secrets, database rights, moral rights, and any other proprietary or intellectual property rights recognized under applicable law.
• "Services": The ${APP_NAME} mobile application, website, APIs, and all related features and functionality, including 1-on-1 live video calls, random user matching, text chat, virtual gifting, and premium subscriptions.
• "Third-Party Services": External platforms, services, applications, or content providers that may be accessed through or in connection with the Services.
• "UGC" (User-Generated Content): Any Content created, submitted, posted, or shared by Users on or through the Services.
• "Virtual Items": Digital goods, including virtual gifts, animated effects, in-app decorations, and premium features that may be purchased using Bonk Coins or real currency.
To use the Services, you must: (a) be at least 18 years of age; (b) not be prohibited from using the Services under the laws of your jurisdiction; (c) not have had a previous account terminated for violating these Terms; and (d) provide accurate, current, and complete registration information.
You may register for an account using a valid email address and password, or by linking a supported third-party social login service (e.g., Google, Apple). You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at service@bonk.today if you suspect unauthorized access to or misuse of your account.
You agree to provide truthful, accurate, and complete information at registration and to keep your account information up to date. Providing false information, including falsifying your age or identity, is a material breach of these Terms and may result in immediate account termination and potential legal action.
Each User may maintain only one active ${APP_NAME} account at a time. Creating multiple accounts to circumvent a suspension or ban, exploit promotional offers, or otherwise abuse the Services is strictly prohibited and will result in termination of all associated accounts.
You are solely responsible for all activity conducted through your account. ${APP_NAME} is not liable for any loss or damage arising from your failure to maintain account security. We recommend using a strong, unique password and enabling any available two-factor authentication features.
Bonk is exclusively intended for adults aged 18 years and older. We maintain a strict no-minors policy across all features of the Services, including but not limited to video calls, text chat, user matching, and virtual gifting. If you are under 18 years of age, you are not permitted to use the Services under any circumstances.
All users are required to enter their date of birth during account registration. ${APP_NAME} reserves the right to employ additional age verification measures, including third-party identity verification services, to enforce this age restriction. Accounts created by or on behalf of individuals under 18 will be permanently terminated upon detection, and any associated funds or virtual items will be forfeited without refund.
If you encounter a user who you believe to be under the age of 18 on the platform, you must report them immediately using the in-app reporting feature or by emailing service@bonk.today. We take all such reports seriously and will investigate and take appropriate action, including account termination and notification of relevant authorities, within 72 hours of verified report.
Parents and legal guardians are advised that ${APP_NAME} is an adult-only platform. If you believe your child has created an account or accessed the Services without your consent, please contact us immediately at service@bonk.today. We will cooperate fully with parents and guardians to secure the removal of a minor's account and associated data.
Bonk has a zero-tolerance policy toward child sexual abuse and exploitation (CSAE) in any form. The following actions are strictly prohibited on our platform and will result in immediate account termination, permanent ban, preservation and reporting of all relevant account data, and mandatory reporting to law enforcement and applicable child protection authorities:
• Uploading, sharing, streaming, distributing, or soliciting child sexual abuse material (CSAM) of any kind, including digitally generated or AI-produced imagery depicting minors in a sexual context.
• Using the Services to groom, solicit, or engage in sexual communication with any person under the age of 18, regardless of whether the minor's identity has been verified.
• Facilitating, organizing, promoting, or enabling the sexual exploitation, trafficking, or abuse of children through any feature of the Services.
• Impersonating a minor or falsely representing oneself as an adult to gain access to interactions with minors.
${APP_NAME} employs a combination of automated CSAM detection technology (including PhotoDNA hash-matching), AI-powered behavioral monitoring, and a dedicated 24/7 Trust and Safety team to proactively identify and respond to CSAE-related activity. All confirmed CSAE incidents are reported without delay to the National Center for Missing and Exploited Children (NCMEC) CyberTipline and to the relevant law enforcement authorities in the applicable jurisdiction. Users who encounter any suspected CSAE activity must report it immediately via the in-app report function or at service@bonk.today.
You may use the Services solely for lawful, personal, non-commercial purposes in accordance with these Terms and our Community Guidelines. Permitted uses include: engaging in real-time 1-on-1 video and text conversations, discovering and connecting with new people through our matching features, sending virtual gifts, and participating in the ${APP_NAME} social community.
You agree that you will not, under any circumstances:
• Use the Services for any illegal purpose or in violation of any applicable local, state, national, or international laws or regulations.
• Post, transmit, or share content that is defamatory, obscene, pornographic, hateful, threatening, harassing, discriminatory, or incites violence against any person or group.
• Impersonate any person or entity, falsely represent your identity or affiliation, or misrepresent your relationship with ${APP_NAME}.
• Engage in spam, unsolicited advertising, phishing, or any deceptive commercial communication through the Services.
• Attempt to gain unauthorized access to any part of the Services, other users' accounts, or ${APP_NAME}'s systems or infrastructure.
• Use automated bots, scrapers, scripts, or other automated means to access, collect data from, or interact with the Services without prior written authorization from ${APP_NAME}.
• Reverse engineer, decompile, disassemble, or otherwise attempt to extract source code from any part of the Services.
• Interfere with, disrupt, or overburden the Services, servers, or networks connected to the Services.
• Exploit bugs or vulnerabilities in the Services for personal gain or to the detriment of other users or ${APP_NAME}.
• Sell, rent, lend, sublicense, or transfer your account or any rights under these Terms to any third party.
• Facilitate or encourage any other person to engage in prohibited conduct described in these Terms.
Violations of this Acceptable Use Policy may result in content removal, formal warnings, temporary suspension, permanent account termination, and, where legally required, reporting to appropriate law enforcement authorities. ${APP_NAME} reserves the right to determine, in its sole discretion, what constitutes a violation and to take appropriate enforcement action.
You are solely responsible for all Content you post, upload, broadcast, send, or otherwise make available through the Services. By submitting Content to ${APP_NAME}, you represent and warrant that: (a) you own or have all necessary rights, licenses, and permissions to submit such Content; (b) the Content does not infringe any third party's Intellectual Property Rights, privacy rights, or other legal rights; and (c) the Content complies with these Terms, our Community Guidelines, and all applicable laws.
By submitting, posting, or sharing Content through the Services, you grant ${APP_NAME} a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, store, distribute, modify, adapt, display, and create derivative works from your Content, solely for the purposes of: (a) operating, providing, and improving the Services; (b) personalizing your experience; (c) promoting and marketing the Services (including in advertising materials, subject to your privacy settings); and (d) complying with applicable laws. This license continues even after you delete your Content or account, to the extent that ${APP_NAME} has shared or archived your Content in accordance with these Terms.
You retain all ownership rights in your original Content, subject to the license granted above. Nothing in these Terms transfers ownership of your Content to ${APP_NAME}. ${APP_NAME} does not claim ownership of your Content.
You agree not to submit Content that:
• Depicts or promotes nudity, sexually explicit material, or adult content of any kind, except where expressly permitted by applicable settings and applicable law.
• Contains graphic violence, gore, self-harm, or content that glorifies, encourages, or facilitates harm to any person or animal.
• Constitutes hate speech, harassment, threats, bullying, stalking, or discriminatory content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Spreads misinformation, propaganda, or deliberately false or misleading information that could cause real-world harm.
• Infringes any third party's copyright, trademark, trade secret, patent, or other Intellectual Property Rights.
• Violates any person's privacy, including sharing personal information of others without their consent ("doxxing").
• Constitutes or facilitates CSAE or any content involving the sexual exploitation of minors, as described in Section 4.5.
${APP_NAME} employs automated and human content moderation to detect and address violations of these Content standards. We reserve the right, but not the obligation, to review, monitor, remove, or restrict any Content at our sole discretion, without prior notice, and without liability to you. Content removal decisions may be appealed by contacting service@bonk.today within 14 days of the action.
If you believe that your copyrighted work has been reproduced on ${APP_NAME} without authorization, please send a complete DMCA notice to service@bonk.today with the subject line "Copyright Infringement Notice." Your notice must include: (a) identification of the copyrighted work; (b) identification of the allegedly infringing content and its location; (c) your contact information; (d) a good-faith statement; and (e) your signature. We will respond to valid notices in accordance with applicable law.
If you voluntarily provide ${APP_NAME} with feedback, suggestions, or ideas about the Services, you grant us an irrevocable, perpetual, worldwide, royalty-free license to use, incorporate, and commercialize such feedback without any obligation or compensation to you.
Bonk offers an in-app virtual currency called "Bonk Coins" and a range of virtual items, including animated gifts, visual effects, profile decorations, and premium feature access. Bonk Coins and Virtual Items are purchased for use exclusively within the Services and have no real-world monetary value. They cannot be exchanged for cash, transferred to other users (except through the gifting mechanism within the Services), or redeemed outside the platform.
You may purchase Bonk Coins through the in-app store, using payment methods supported by the respective app marketplace (Apple App Store or Google Play Store) or any direct payment options we provide. All purchases are processed by the applicable marketplace or payment processor, and their terms of service also apply to your transaction. By completing a purchase, you authorize the applicable charge to your payment method.
Prices for Bonk Coins and Virtual Items are displayed in your local currency or USD equivalent at the point of purchase. Prices are subject to change without prior notice. You are responsible for all applicable taxes, duties, and transaction fees associated with your purchase, unless otherwise indicated at the point of sale.
ALL PURCHASES OF BONK COINS AND VIRTUAL ITEMS ARE FINAL AND NON-REFUNDABLE, except as required by applicable law or as expressly stated in this Section 7. Once Bonk Coins have been used to purchase Virtual Items or gifted to other users, those transactions cannot be reversed. This no-refund policy reflects the digital and immediately consumable nature of Virtual Items.
${APP_NAME} may, at its sole discretion, issue refunds or credits in the following limited circumstances:
• Technical errors caused solely by ${APP_NAME} that result in a failed purchase where Bonk Coins or payment were deducted but no Virtual Item was delivered.
• Unauthorized transactions demonstrated to have been made without your knowledge or consent, provided you report the transaction within 7 days of the charge and provide supporting evidence.
• Refunds required by mandatory consumer protection laws in your jurisdiction that cannot be contractually waived.
To request a refund under one of the above circumstances, contact our support team at service@bonk.today with the subject line "Refund Request" within the applicable timeframe. We will review your request and respond within 10 business days. Refund requests submitted to the Apple App Store or Google Play Store are handled according to those platforms' respective refund policies, and ${APP_NAME} may have limited ability to influence their outcome.
If your account is suspended or terminated by ${APP_NAME} for a violation of these Terms, all unused Bonk Coins and Virtual Items in your account will be permanently forfeited without compensation. You acknowledge that all rights to Virtual Items are a limited license that terminates upon account closure, whether voluntary or involuntary.
${APP_NAME} may offer auto-renewing subscription plans ("Premium Subscriptions") that unlock additional features or benefits. By subscribing, you authorize ${APP_NAME} or the applicable marketplace to charge your payment method on a recurring basis at the then-current subscription price until you cancel. You may cancel your subscription at any time through your device's account settings (App Store or Google Play). Cancellation will take effect at the end of the current billing period, and no refunds will be issued for unused portions of a subscription period unless required by applicable law.
${APP_NAME} reserves the right to modify, adjust, or discontinue any Virtual Items, Bonk Coin denominations, pricing structures, or Virtual Item features at any time. We will provide reasonable notice of material changes to the virtual economy where practicable. ${APP_NAME} shall have no liability for such modifications except where required by applicable law.
If you have a billing dispute, please first contact ${APP_NAME} support at service@bonk.today before initiating a chargeback with your payment provider. Most billing issues can be resolved quickly through our support team. Initiating a chargeback without first contacting support may result in temporary account suspension while the dispute is investigated. ${APP_NAME} reserves the right to permanently terminate accounts found to have abused the chargeback process.
${APP_NAME} enables real-time 1-on-1 live video calls between registered users. You may initiate a call with a specific user from your connection list or contact a recently matched user. By participating in a video call, you consent to being seen and heard by the other party for the duration of the call. You must not record, capture, or screenshot video calls without the prior explicit consent of all participating parties. Unauthorized recording of video calls is a violation of these Terms and may violate applicable privacy laws.
${APP_NAME} offers a random matching feature that pairs you with another available user for a spontaneous 1-on-1 video call. By activating this feature, you acknowledge that you may be connected with any user who has opted into random matching, regardless of geography. You may skip or end a random call at any time without penalty. ${APP_NAME} is not responsible for the conduct or Content of other users during random matched calls.
All Community Guidelines and Content standards described in Sections 5 and 6 apply in full during live video calls. You must not expose nudity, engage in sexually explicit behavior, display hate symbols, or engage in any prohibited conduct during a video call. Violations detected by automated monitoring or reported by other users may result in immediate call termination, temporary or permanent account suspension, and escalation to appropriate authorities where required.
${APP_NAME} does not guarantee the uninterrupted availability, quality, or latency of video calls, as call performance is dependent on your device capabilities, internet connection, and network conditions. We are not liable for any loss or inconvenience arising from call interruptions, dropped connections, or degraded call quality.
${APP_NAME} provides in-app text messaging functionality that allows registered users to exchange text messages, stickers, and media within the platform. All text chat communications are subject to these Terms and our Community Guidelines. ${APP_NAME} may scan and review message content using automated tools for the purpose of safety enforcement. By using the text chat feature, you acknowledge that your messages may be reviewed by our Trust and Safety team in response to reports or safety investigations.
Users may send Virtual Items, including animated gifts and interactive effects, to other users as a form of appreciation or interaction. Virtual gifts are purchased using Bonk Coins and have no real-world cash value. The recipient of a virtual gift does not receive any monetary compensation unless ${APP_NAME} has explicitly established a creator monetization program with stated terms. Gift transactions are logged and may be reviewed by our team for fraud detection or dispute resolution purposes.
The chat and gifting features are provided for personal social interaction only. Using these features to solicit commercial transactions, promote third-party businesses, request real-world payments, share referral links outside of authorized programs, or engage in any form of paid companionship or escort service is strictly prohibited.
The Services, including their underlying technology, software, design, logos, trademarks, service marks, trade names, user interface elements, graphics, text, audio, and all other content provided by ${APP_NAME} (excluding User-Generated Content), are the exclusive property of ${APP_NAME} or its licensors and are protected by applicable Intellectual Property Rights laws worldwide. Nothing in these Terms grants you any ownership interest in ${APP_NAME}'s Intellectual Property.
Subject to your compliance with these Terms, ${APP_NAME} grants you a limited, non-exclusive, non-transferable, revocable, personal license to download and use the ${APP_NAME} app on your personal device solely for your personal, non-commercial use of the Services. This license does not include any right to: (a) sublicense or distribute the app; (b) create derivative works; (c) use the Services for commercial purposes; or (d) use ${APP_NAME}'s trademarks or branding without prior written consent.
"Bonk," the ${APP_NAME} logo, and all associated marks are trademarks or service marks of ${APP_NAME}. You may not use any ${APP_NAME} trademark in any manner that could cause confusion, misrepresentation, or that disparages or discredits ${APP_NAME}, without our prior written consent.
Your use of the Services is governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, store, and share your personal information. By agreeing to these Terms, you also acknowledge and agree to our Privacy Policy.
We encourage you to review our Privacy Policy carefully before using the Services. It is available within the app and at our official website. If you have questions about our data practices, please contact us at service@bonk.today.
The Services may integrate with, link to, or allow access to third-party services, platforms, or content, including but not limited to social login providers, payment processors, and analytics tools. ${APP_NAME} does not control and is not responsible for the content, privacy practices, or reliability of any third-party services. Your use of third-party services is governed solely by their respective terms and privacy policies.
The presence of a link or integration to a third-party service does not constitute ${APP_NAME}'s endorsement of that service. We provide such integrations for your convenience only and make no warranties regarding the accuracy, suitability, or availability of any third-party content or services.
If you downloaded ${APP_NAME} from the Apple App Store, you also agree to Apple's Terms and Conditions, which take precedence over these Terms in the event of a conflict with respect to your use of the App Store. Apple is not responsible for ${APP_NAME} or its content and has no obligation to provide support for the Services. Similarly, if you downloaded ${APP_NAME} from the Google Play Store, Google's Terms of Service also apply.
${APP_NAME} strives to maintain continuous, uninterrupted availability of the Services. However, we do not warrant that the Services will be available at all times or free from technical disruptions. We reserve the right to temporarily suspend or limit access to the Services for maintenance, upgrades, or security reasons, with or without prior notice.
${APP_NAME} reserves the right to add, modify, suspend, or discontinue any features, functionalities, or aspects of the Services at any time, with or without prior notice. We will make reasonable efforts to communicate significant changes through in-app notifications, email, or our official website. ${APP_NAME} shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services or any part thereof.
We reserve the right to revise these Terms at any time. When we make material changes, we will notify you via in-app alert, email, or a prominent notice on our website at least 14 days before the changes take effect. By continuing to use the Services after the effective date of any revised Terms, you agree to be bound by the updated version. If you disagree with the changes, you must stop using the Services and may request account deletion.
You may close your ${APP_NAME} account at any time by using the "Delete Account" feature in the app settings or by contacting us at service@bonk.today. Upon deletion, your profile will be removed from public view, and your personal data will be processed in accordance with our Privacy Policy. Note that certain data may be retained for legal compliance, safety investigations, or fraud prevention as described in the Privacy Policy.
${APP_NAME} reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without prior notice, if we reasonably determine that you have: (a) violated any provision of these Terms or our Community Guidelines; (b) engaged in fraudulent, abusive, or harmful behavior; (c) provided false registration information; (d) failed to meet the age eligibility requirement; or (e) posed a risk to the safety or security of the platform or other users.
Upon termination of your account, regardless of reason: (a) your license to use the Services will immediately cease; (b) any unused Bonk Coins or Virtual Items in your account will be forfeited without refund; (c) ${APP_NAME} may delete your account data in accordance with our Privacy Policy; and (d) provisions of these Terms that are intended to survive termination (including Sections 6.2, 7.4, 15, 16, 17, 18, 19, and 20) shall continue in full force and effect.
If you believe your account was suspended or terminated in error, you may submit an appeal to service@bonk.today within 14 days of the action. Provide your registered email address, the nature of the appeal, and any supporting evidence. ${APP_NAME} will review appeals in good faith and respond within 10 business days. All appeal decisions are final.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BONK EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Bonk does not warrant the accuracy, completeness, quality, legality, or safety of any User-Generated Content appearing on the Services. You acknowledge that you may be exposed to Content that is inaccurate, offensive, indecent, or objectionable, and you agree that Bonk shall not be liable to you for any such Content.
Bonk does not represent or warrant that any particular user you interact with through the Services is who they claim to be, that any user's intentions are honest or benign, or that the Services will result in any particular social outcome. You use the Services and interact with other users entirely at your own risk.
Bonk does not warrant that the Services will be error-free, virus-free, continuously available, or that defects will be corrected. The Services may be subject to limitations, delays, and other problems inherent in the use of internet and electronic communications. Bonk is not responsible for any delays, delivery failures, or other damage resulting from such problems.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BONK, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTIONS, COMPUTER DAMAGE, OR SYSTEM FAILURES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BONK'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU HAVE PAID TO BONK IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED US DOLLARS (USD $100.00).
You acknowledge that ${APP_NAME} has set its pricing and entered into these Terms in reliance upon the disclaimers and limitations of liability stated herein, and that these form an essential basis of the agreement between you and ${APP_NAME}. The foregoing limitations shall apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for certain types of damages. To the extent that such limitations are not permitted in your jurisdiction, the above limitations or exclusions may not apply to you, and ${APP_NAME}'s liability will be limited to the fullest extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless Bonk, its affiliates, subsidiaries, parents, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, demands, actions, damages, liabilities, losses, costs, and expenses (including reasonable legal fees and court costs) arising out of or relating to:
• Your use of or access to the Services.
• Your violation of any provision of these Terms, our Community Guidelines, or applicable law.
• Your User-Generated Content, including any claim that your Content infringes the rights of any third party.
• Your interaction with any other user of the Services, including disputes, harassment claims, or harm arising from your conduct.
• Your misrepresentation of any information provided to ${APP_NAME}.
Bonk reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with Bonk's defense of such claim and not to settle any claim without Bonk's prior written consent.
These Terms and all disputes arising out of or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the applicable jurisdiction in which Bonk is registered and primarily operates, without regard to its conflict of law principles. Users in the European Union, United Kingdom, and other jurisdictions retain any mandatory consumer protection rights afforded by local law that cannot be contractually waived.
Before initiating formal dispute resolution, you agree to first contact ${APP_NAME} at service@bonk.today and describe the nature of your dispute in detail. We will make good-faith efforts to resolve your concern within 30 days of receipt. Many disputes can be resolved quickly through direct communication, and we strongly encourage this as the first step.
If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the Services that cannot be resolved through informal negotiation shall be finally resolved through binding arbitration under the rules of a recognized arbitral institution (e.g., the International Chamber of Commerce (ICC) or the American Arbitration Association (AAA)). The arbitration shall be conducted on an individual basis; class action or class-wide arbitration is not permitted. The arbitrator's decision shall be final and binding, and judgment may be entered upon the arbitral award in any court of competent jurisdiction.
YOU AND ${APP_NAME} EACH AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES ARISING UNDER THESE TERMS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS. NEITHER YOU NOR ${APP_NAME} MAY CONSOLIDATE CLAIMS WITH THOSE OF ANY OTHER USER, PARTICIPATE IN A CLASS ACTION, OR OTHERWISE SEEK RELIEF ON A REPRESENTATIVE BASIS AGAINST THE OTHER PARTY, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to protect its Intellectual Property Rights or to prevent irreparable harm pending the outcome of arbitration. Nothing in this Section shall prevent ${APP_NAME} from bringing a claim before a small claims court of competent jurisdiction.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY CLAIM OR CAUSE OF ACTION ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE, OR BE FOREVER BARRED.
Bonk shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, war, terrorism, civil unrest, governmental actions or restrictions, strikes or labor disputes, power outages, internet infrastructure failures, cyberattacks, or actions of third-party service providers.
In such circumstances, ${APP_NAME}'s obligations will be suspended for the duration of the force majeure event. We will make reasonable efforts to notify you of any significant service disruption caused by such events and to restore the Services as promptly as practicable.
You agree to comply with all applicable export control laws and regulations, including those of the United States, the European Union, and any other relevant jurisdiction. You represent and warrant that you are not located in, nor a national or resident of, any country subject to comprehensive international sanctions (e.g., as administered by OFAC, the EU, or the UN), and that you are not listed on any government list of prohibited or restricted parties.
You further agree to use the Services only in compliance with all applicable local, national, and international laws and regulations, including those governing data privacy, consumer protection, and telecommunications. It is your responsibility to ensure that your use of the Services is lawful in the jurisdiction from which you access them.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.
${APP_NAME}'s failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of ${APP_NAME}.
These Terms, together with the Privacy Policy, Community Guidelines, and any other policies or agreements incorporated herein by reference, constitute the entire agreement between you and ${APP_NAME} with respect to the Services and supersede all prior agreements, representations, and understandings, whether oral or written, between you and ${APP_NAME} relating to the Services.
You may not assign or transfer any rights or obligations under these Terms to any third party without the prior written consent of ${APP_NAME}. ${APP_NAME} may freely assign its rights and obligations under these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
