5. Legal Basis for Processing Personal Data

For users in the European Economic Area (EEA), United Kingdom, and other jurisdictions that require a legal basis for data processing, we rely on the following:

5.1 Contractual Necessity

Processing your account information, facilitating video calls and text chats, handling payments, and providing core app functionality is necessary to perform our contract with you under the Terms of Service.

5.2 Legitimate Interests

We process certain data based on our legitimate interests, balanced against your privacy rights, including: improving and securing our Services, preventing fraud and abuse, conducting analytics, and communicating service-related updates. We do not override your fundamental rights and freedoms in doing so.

5.3 Consent

We rely on your consent for processing that is not strictly necessary for the Services, including sending marketing communications, collecting precise location data, using non-essential cookies, and processing sensitive personal information where required by law. You may withdraw consent at any time through your account settings or by contacting us at the email listed in Section 20.

5.4 Legal Obligation

We may process data as required to comply with applicable laws and regulations, such as responding to lawful government requests, fulfilling tax reporting obligations, or complying with court orders.

6. Information Sharing and Disclosure

Bonk does not sell your personal information to third parties for monetary compensation. However, we may share your information in the specific circumstances described below, always in accordance with applicable law and with appropriate safeguards in place.

6.1 With Other Users

Certain information you include in your public profile (such as your display name, avatar, bio, and general location) is visible to other users of the platform. Video and voice call content is shared directly between call participants in real time. Text messages and gifts are visible to the recipient. You control the level of detail in your public profile through your privacy settings.

6.2 With Service Providers and Vendors

We engage carefully vetted third-party service providers who assist us in operating our Services. These providers process data solely on our behalf and under strict contractual obligations:

Cloud infrastructure and hosting providers (e.g., Amazon Web Services, Google Cloud) for data storage and computing.

Real-time communication infrastructure providers for video and voice call relay services.

Payment processors (e.g., Stripe, Apple Pay, Google Pay) for secure transaction handling.

Analytics platforms (e.g., Firebase Analytics, Amplitude) for usage and performance analysis.

Push notification services (e.g., Firebase Cloud Messaging, APNs) for delivering alerts.

Customer support platforms for managing user inquiries and tickets.

Content moderation vendors for automated and manual review of reported content.

6.3 With Advertising Partners

We may share anonymized, aggregated, or pseudonymized device identifiers and behavioral data with advertising networks and attribution partners to measure ad campaign effectiveness, deliver relevant advertisements within the app, and optimize our marketing spend. We do not share directly identifiable personal information (such as your name or email) with advertisers without your explicit consent.

6.4 For Legal and Safety Reasons

We may disclose your information when we reasonably believe disclosure is necessary to:

Comply with applicable laws, regulations, subpoenas, warrants, or court orders.

Respond to requests from law enforcement, government agencies, or regulatory authorities.

Protect the safety, rights, or property of ${APP_NAME}, our users, or the public.

Detect, prevent, or investigate fraud, security breaches, or violations of our Terms of Service.

Enforce our agreements, policies, and legal rights.

6.5 Business Transfers

In the event of a merger, acquisition, asset sale, corporate restructuring, or other business combination, your information may be transferred to the acquiring or successor entity. We will notify you via in-app notification or email at least 30 days before any such transfer, and you will be given the option to delete your account before the transfer takes effect.

6.6 With Your Consent

We may share your information with third parties not described above when we have obtained your express, informed consent to do so. You may revoke such consent at any time, though revocation will not affect the lawfulness of processing that occurred prior to consent withdrawal.

7. Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, to comply with our legal obligations, resolve disputes, enforce our agreements, and support legitimate business operations.

7.1 Account Data

Your account information is retained for as long as your account is active. Upon account deletion, we will begin the process of permanently deleting or anonymizing your personal data within 30 days, subject to the exceptions below.

7.2 Communication Data

Text chat messages are retained for a limited period to support safety and moderation processes (typically up to 90 days after the last interaction), after which they are automatically deleted. Video call content is not recorded or stored on our servers unless you explicitly activate a recording feature, if available.

7.3 Financial Records

Transaction records, billing information, and payment history are retained for a minimum of 7 years from the date of transaction to comply with applicable tax, accounting, and financial regulatory requirements.

7.4 Safety and Legal Hold Data

If your account has been involved in a safety investigation, legal proceeding, or regulatory inquiry, relevant data may be retained beyond standard retention periods until the matter is resolved. Data subject to a legal hold will be preserved until the hold is lifted or the legal matter is concluded.

7.5 Anonymized Data

We may retain de-identified or aggregated data derived from your information indefinitely for analytics, research, product development, and statistical purposes, as such data no longer constitutes personal information.

8. Cookies and Tracking Technologies

Bonk uses cookies and similar tracking technologies on our website and within our mobile application to improve performance, understand user behavior, and deliver relevant advertising.

8.1 Types of Technologies Used

Temporary cookies that expire when you close your browser or app session. Used to maintain your login state and session preferences. Session Cookies:

Cookies stored on your device for a defined period. Used to remember language preferences, theme settings, and returning user recognition. Persistent Cookies:

Cookies set by our analytics partners (e.g., Google Analytics, Firebase) to collect information about how users interact with our Services, which pages are most visited, and how long sessions last. Analytical and Performance Cookies:

Cookies used by advertising networks to measure ad impressions, clicks, and conversions, and to serve targeted advertisements based on your interests and browsing behavior. Advertising and Attribution Cookies:

Cookies used to authenticate users, detect and prevent fraudulent logins, and protect account security. Security Cookies:

8.2 Your Cookie Choices

You can manage cookie preferences through your browser or device settings. Disabling certain cookies may affect the functionality of some features. Where required by law, we will present a cookie consent banner giving you the ability to accept or reject non-essential cookies before they are set.

9. User-Generated Content (UGC) Policy

Bonk is a platform built around real-time social interaction. Users may upload, share, broadcast, or otherwise submit content including profile photos, video streams, text messages, images sent in chat, virtual gift interactions, and other media. This section describes how we handle that content.

9.1 Content You Share

Any content you post or share on ${APP_NAME} - including profile images, bio text, messages, and content shared during video sessions - is considered User-Generated Content ("UGC"). You retain ownership of your UGC, subject to the license described in our Terms of Service. By submitting UGC, you grant ${APP_NAME} a worldwide, royalty-free, non-exclusive license to use, store, process, display, and distribute that content solely for the purpose of operating and improving the Services.

9.2 Content Storage and Processing

Profile photos and bio information are stored on our servers and displayed to other users as part of your public profile.

Text chat messages are encrypted in transit and stored temporarily on our servers to support message delivery, synchronization across devices, and safety review. Messages are subject to automated content moderation.

Video streams are transmitted in real time between users. We do not record or permanently store live video call content unless a recording feature is explicitly activated by a user and both parties have been notified.

Virtual gifts and interactive content events are logged for transaction records and displayed within the relevant chat thread.

9.3 Content Moderation

We employ a combination of automated AI-powered content moderation tools and human review to detect and address content that violates our Community Guidelines and Terms of Service. This includes, but is not limited to, sexually explicit content, hate speech, harassment, graphic violence, illegal content, and content that endangers minors.

9.4 Reporting and Enforcement

Users may report content or behavior that they believe violates our policies using the in-app reporting function. Upon receiving a report, our Trust and Safety team will review the content and take appropriate action, which may include content removal, account warning, temporary suspension, or permanent ban. Serious violations, including those involving child safety, are reported to relevant authorities in compliance with applicable law.

9.5 Intellectual Property and Copyright

You represent and warrant that you own or have all necessary rights to the UGC you submit and that it does not infringe any third party's intellectual property, privacy, or other rights. If you believe that your copyrighted content has been infringed on ${APP_NAME}, please contact us at service@bonk.today with a detailed infringement notice, and we will respond in accordance with applicable copyright law, including the Digital Millennium Copyright Act (DMCA) where applicable.

9.6 Content Deletion

You may delete your own messages, profile content, and other UGC at any time through the app interface. Deleted content will be removed from visible areas of the platform promptly; however, residual copies may persist in backups or caches for up to 30 days before permanent deletion. Content that has been shared with other users (e.g., a message received by another party) may not be fully removable from that party's device.

10. Data Security

Bonk takes the security of your personal information seriously. We implement a multi-layered security architecture designed to protect your data against unauthorized access, disclosure, alteration, loss, or destruction.

10.1 Technical Safeguards

All data transmitted between your device and our servers is encrypted using Transport Layer Security (TLS 1.2 or higher).

Sensitive data at rest (including account credentials, payment information, and personal identifiers) is encrypted using AES-256 encryption or equivalent standards.

Passwords are hashed using industry-standard algorithms (bcrypt or Argon2) and are never stored in plaintext.

Our video and audio communication infrastructure uses end-to-end or server-side encryption protocols to protect the confidentiality of calls in transit.

We maintain firewalls, intrusion detection and prevention systems (IDPS), DDoS protection, and regular vulnerability scanning across our infrastructure.

10.2 Organizational Safeguards

Access to personal data is restricted on a strict need-to-know basis, with role-based access controls (RBAC) enforced across our internal systems.

All employees and contractors with access to personal data are subject to confidentiality obligations and receive regular training on data protection best practices.

We conduct periodic security audits, penetration testing, and code reviews to identify and remediate vulnerabilities.

A dedicated security team monitors for threats, incidents, and anomalous behavior around the clock.

10.3 Breach Response

In the event of a personal data breach that poses a risk to your rights and freedoms, we will notify affected users and relevant regulatory authorities within the timeframes required by applicable law (e.g., 72 hours under GDPR). Notifications will include the nature of the breach, categories of data affected, likely consequences, and steps taken to mitigate harm.

10.4 Your Responsibility

While we take all reasonable steps to protect your data, no transmission over the internet or electronic storage method is 100% secure. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. Please notify us immediately at service@bonk.today if you suspect unauthorized access or a security breach involving your account.

11. International Data Transfers

Bonk operates globally, and your personal information may be transferred to, stored in, and processed in countries other than your country of residence. These countries may have data protection laws that differ from those in your jurisdiction.

11.1 Transfer Mechanisms

For transfers of personal data outside the EEA or UK to countries without an adequacy decision, we rely on appropriate safeguards, including:

Standard Contractual Clauses (SCCs) approved by the European Commission or UK Information Commissioner's Office.

Binding Corporate Rules (BCRs) where applicable for intra-group transfers.

Derogations permitted under Article 49 of the GDPR in specific circumstances (e.g., where the transfer is necessary to perform a contract at your request).

11.2 Data Localization

Where required by local law, we take steps to ensure that certain categories of personal data are stored or processed within specified geographic boundaries. For example, certain user data relating to residents of specific jurisdictions may be kept within regional data centers.

12. Your Privacy Rights and Choices

Depending on your jurisdiction, you may have the following rights with respect to your personal information. We are committed to honoring these rights promptly and without undue delay.

12.1 Right of Access

You have the right to request a copy of the personal data we hold about you, including information about how it is being used, the categories of data held, who it has been shared with, and the legal basis for processing. You can request this information through your in-app account settings or by emailing us at service@bonk.today.

12.2 Right to Rectification

If any personal information we hold about you is inaccurate, outdated, or incomplete, you have the right to request its correction. You may update most profile information directly within the app. For other corrections, contact us at service@bonk.today.

12.3 Right to Erasure (Right to be Forgotten)

You may request that we delete your personal data. Upon receiving such a request, we will delete your information within 30 days, subject to legal obligations that require us to retain certain data (e.g., financial records, safety investigations, legal holds). To delete your account and associated data, use the "Delete Account" option in Settings or contact us directly.

12.4 Right to Restriction of Processing

You may request that we restrict the processing of your personal data in certain circumstances - for example, if you contest the accuracy of the data, object to its processing, or require it to be retained for legal claims. During the restriction period, we will only process the data with your consent or for legal claims.

12.5 Right to Data Portability

Where technically feasible and legally required, you have the right to receive a copy of your personal data in a structured, commonly used, and machine-readable format, and to transmit that data to another service provider. You can request a data export through your account settings.

12.6 Right to Object

You have the right to object at any time to the processing of your personal data for direct marketing purposes. You may also object to processing based on our legitimate interests where you believe your fundamental rights and freedoms override those interests.

12.7 Right to Withdraw Consent

Where we rely on your consent as the legal basis for processing, you may withdraw that consent at any time without affecting the lawfulness of processing carried out before withdrawal. To withdraw consent for marketing communications, use the unsubscribe link in the relevant communication or update your notification preferences in the app.

12.8 How to Exercise Your Rights

To exercise any of the above rights, please contact our Privacy Team at service@bonk.today with the subject line "Privacy Rights Request." We will verify your identity before processing your request and respond within the timeframe required by applicable law (generally within 30 days, with a possible extension of an additional 60 days for complex requests). We will not charge a fee for reasonable requests unless they are repetitive or manifestly unfounded.

13. Push Notifications and Communications

13.1 Push Notifications

We may send you push notifications to alert you to new messages, call requests, matched users, system updates, and promotional offers. You can manage push notification preferences through your device's operating system settings or within the ${APP_NAME} app under Settings > Notifications.

13.2 Email Communications

We may send you transactional emails (e.g., account verification, password reset, payment confirmation) and, with your consent, promotional emails about new features and special offers. You can unsubscribe from marketing emails at any time by clicking the "Unsubscribe" link included in each email or by updating your preferences at service@bonk.today. Unsubscribing from marketing emails will not affect the delivery of transactional emails necessary for the Services.

13.3 In-App Communications

We may deliver important announcements, policy updates, and promotional content directly within the app interface. These in-app messages are an integral part of the Services and cannot be fully disabled, though their frequency and content may vary.

14. Third-Party Links and Integrations

Bonk may contain links to third-party websites, apps, or services, including social login providers, payment processors, and advertising networks. These third parties operate independently and are governed by their own privacy policies. Bonk does not control, and is not responsible for, the privacy practices or content of third-party services.

We encourage you to review the privacy policies of any third-party services you interact with through or in connection with ${APP_NAME}. Your use of third-party features is at your own risk and subject to those third parties' terms.

15. Do Not Track Signals

Some browsers and devices offer a "Do Not Track" (DNT) setting that sends a signal to websites requesting that your browsing not be tracked. Currently, ${APP_NAME} does not respond to DNT signals, as no uniform industry standard has been established for honoring such signals. We will revisit this position as industry standards evolve.

California residents may opt out of the sale or sharing of personal information for cross-context behavioral advertising purposes under the CCPA/CPRA by emailing us at service@bonk.today with the subject line "Opt-Out of Sale/Sharing" or by using the in-app privacy settings, where available.

16. Advertising and Analytics

16.1 Advertising

${APP_NAME} may display advertisements within the app served by third-party ad networks. These networks may use device identifiers (such as the Advertising ID on Android or the IDFA on iOS) and behavioral data to deliver personalized advertisements. You can opt out of personalized advertising by resetting your Advertising ID or disabling ad personalization in your device settings. On iOS, you can use the App Tracking Transparency (ATT) framework to control tracking.

16.2 Analytics

We use third-party analytics tools to understand how our app is used, measure engagement, identify areas for improvement, and make data-driven product decisions. These analytics providers may collect data through SDKs embedded in our app and are bound by contractual obligations to use that data only for the purposes we specify. Aggregated, anonymized analytics data does not identify individual users.

17. Children's Privacy Protection

Bonk is strictly intended for users who are 18 years of age or older. We do not knowingly collect personal information from children under the age of 18 (or the applicable age of majority in their jurisdiction). If we discover that we have inadvertently collected personal data from a minor, we will promptly delete such information and terminate the associated account.

17.1 Age Verification

During account registration, users are required to enter their date of birth. Accounts created by individuals under 18 are not permitted and will be terminated upon detection. We may implement additional age verification measures from time to time, including third-party identity verification services, to strengthen our age-gating procedures.

17.2 Parental Notification and Contact

If you are a parent or guardian and believe that your child under 18 has created an account or provided personal information to ${APP_NAME} without your consent, please contact us immediately at service@bonk.today. We will investigate and take appropriate action, including deletion of the minor's account and associated personal data, within 72 hours of verification.

17.3 Child Sexual Abuse and Exploitation (CSAE)

Bonk maintains a strict zero-tolerance policy toward child sexual abuse and exploitation (CSAE) in all forms. We are committed to the protection of minors from sexual exploitation and abuse, and we actively implement the following measures:

All uploaded content, including profile images and in-app media, is scanned using PhotoDNA and similar hash-matching technologies to detect and remove known child sexual abuse material (CSAM).

We employ AI-powered behavioral analysis to identify patterns consistent with grooming, predatory behavior, or attempts to exploit minors.

Any content or behavior involving the sexual exploitation, abuse, or solicitation of minors is immediately removed and reported to the National Center for Missing and Exploited Children (NCMEC) CyberTipline in the United States, and to relevant authorities in other jurisdictions as required by law.

${APP_NAME} maintains membership in or cooperation with relevant industry coalitions and organizations dedicated to the eradication of CSAE online, including the Technology Coalition and applicable CSAE reporting frameworks.

Users who engage in CSAE-related activities are permanently banned, reported to law enforcement, and their account data is preserved and provided to authorities in compliance with applicable law.

We have a dedicated Trust and Safety team that monitors, investigates, and responds to CSAE-related reports on a 24/7 basis.

17.4 Reporting CSAE

If you encounter any content or behavior on ${APP_NAME} that you suspect involves the sexual abuse or exploitation of a child, please report it immediately using the in-app reporting feature or by emailing service@bonk.today. You may also report directly to NCMEC at www.cybertipline.org or contact your local law enforcement authorities. We take every report seriously and act swiftly to protect child safety.

18. Sensitive Personal Information

Certain categories of personal information are considered sensitive and require additional protection under applicable privacy laws. These may include racial or ethnic origin, political opinions, religious beliefs, health or medical data, sexual orientation, and biometric data.

${APP_NAME} does not intentionally or systematically collect sensitive personal information about our users. While users may voluntarily disclose sensitive information in their profile or during conversations, we do not process such information for profiling, targeting, or decision-making purposes. If you choose to share sensitive information, you do so voluntarily, and we ask that you exercise caution about what you disclose in public or semi-public areas of the app.

19. Privacy Policy Updates

We may update this Privacy Policy from time to time to reflect changes in our Services, applicable laws, or data processing practices. We are committed to notifying you of any material changes in a clear and timely manner.

19.1 How We Notify You

In-App Notification: We will display a prominent in-app banner or modal when significant changes are made, prompting you to review the updated Policy.

Email Notification: For material changes that significantly affect your rights or how we use your data, we will send an email notification to the address associated with your account at least 14 days before the changes take effect.

Revised Effective Date: The top of this document will always display the current effective date so you can easily determine when the Policy was last updated.

19.2 Continued Use as Acceptance

Your continued use of ${APP_NAME} after any changes to this Policy take effect constitutes your acceptance of the revised Policy. If you do not agree with a revised version of this Policy, you must stop using the Services and may request deletion of your account at any time.

19.3 Policy Archive

Previous versions of this Privacy Policy are available upon request by emailing service@bonk.today. We maintain an archive of superseded policies for a period of at least 3 years.

20. Additional Rights for California Residents

California residents have additional rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA):

Right to Know: You may request details about the categories and specific pieces of personal information collected, the sources and purposes of collection, and the categories of third parties with whom we share information.

Right to Delete: You may request deletion of personal information, subject to exceptions (e.g., information needed to fulfill an ongoing transaction or comply with legal obligations).

Right to Correct: You may request correction of inaccurate personal information we hold.

Right to Opt-Out of Sale/Sharing: You have the right to opt out of the sale or sharing of your personal information for cross-context behavioral advertising. Submit opt-out requests to service@bonk.today.

Right to Limit Use of Sensitive Personal Information: Where applicable, you may limit our use of sensitive personal information to only that which is necessary to provide the requested Services.

Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.

To exercise these rights, contact us at service@bonk.today with the subject line "California Privacy Rights Request" and we will respond within 45 days.

21. Accessibility

We are committed to making this Privacy Policy accessible to all users. If you require this Policy in an alternative format - such as large print, audio, or another accessible format - please contact us at service@bonk.today and we will accommodate your request to the best of our ability.
